Intellectual Property & Artwork Policy

DRAFT v0.1 — last generated 2026-07-27 · requires attorney review

1. You must own or have rights to your artwork

[DRAFT] By uploading artwork or creating a design, you warrant that you own it or hold all rights and permissions needed to reproduce it on merchandise — including copyrights, trademarks, and rights of publicity for any person's name, image or likeness. Do not upload logos, characters, celebrities, sports marks, or brand designs you do not have written permission to use.

2. You indemnify us

[DRAFT — attorney to draft properly] You agree to defend, indemnify and hold harmless Spectrum Custom Works and its owners and staff from any claim, demand, loss or expense (including reasonable attorneys' fees) arising from artwork you supplied — including claims of copyright or trademark infringement, or violation of publicity or privacy rights.

3. We may refuse any job

[DRAFT] We may decline, pause or cancel any order at our sole discretion — including designs we believe infringe someone's rights, or content that is unlawful, hateful, or that we simply choose not to print. If we cancel before production, you receive a full refund.

4. DMCA — reporting infringement

[DRAFT] If you believe artwork on this site or produced through it infringes your copyright, send a takedown notice to our designated contact: hello@spectrumcustomworks.com (subject 'DMCA'). Include:

  1. identification of the copyrighted work;
  2. the URL or description of the infringing material;
  3. your contact information;
  4. a statement of good-faith belief that the use is unauthorized;
  5. a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized agent; and
  6. your physical or electronic signature.

[DRAFT] On receipt of a valid notice we will remove or disable the material and notify the user who supplied it. That user may submit a counter-notice with the elements required by 17 U.S.C. §512(g); if we receive one, we may restore the material after 10–14 business days unless the complainant files a court action. We may terminate repeat infringers. [Attorney: confirm whether formal DMCA agent registration with the Copyright Office is desired.]

5. Our designs and site content

[DRAFT] The design tool, site content, product mockups and the 'Shirty' character are ours; you may not reuse them outside ordering from us.
